2. Anti-Money Laundering (AML) Compliance
2.1 POCAMLA Compliance
SecureEscrow Kenya complies with the Proceeds of Crime and Anti-Money Laundering Act (POCAMLA) and its regulations. Our AML program includes:
- Customer Due Diligence (CDD) for all users
- Enhanced Due Diligence (EDD) for high-risk transactions
- Transaction monitoring and suspicious activity reporting
- Staff training on AML obligations
- Independent annual AML audit
2.2 Know Your Customer (KYC)
All users must complete KYC verification before initiating transactions above KES 100,000. Verification requires:
- Valid government-issued identification
- Proof of address (utility bill or bank statement)
- KRA PIN certificate
- Source of funds declaration for large transactions
2.3 Suspicious Transaction Reporting
We are obligated to report suspicious transactions to the Financial Reporting Centre (FRC). We may not disclose to users that a report has been filed.
3. Data Protection Compliance
3.1 Data Protection Act, 2019
SecureEscrow Kenya is registered as a Data Controller and Data Processor under the Data Protection Act, 2019.

3.3 Cross-Border Data Transfers
Any transfer of personal data outside Kenya complies with the Data Protection Act requirements, including appropriate safeguards and user consent.

4.1 Central Bank of Kenya Guidelines
While SecureEscrow is not a bank or deposit-taking institution, we follow CBK guidelines on:
- Consumer protection in financial services

4.2 Trust Account Management
All client funds are held in segregated trust accounts with:
- Licensed commercial banks regulated by CBK
- Complete separation from operating accounts

As a Safaricom partner, we comply with:

- M-PESA Consumer Protection Guidelines
- Transaction limits and reporting requirements
9. Complaint Handling
We maintain a formal complaint handling procedure in compliance with regulatory requirements. Complaints may be escalated to:

- Office of the Data Protection Commissioner (for privacy concerns)
- Competition Authority of Kenya (for consumer protection issues)
10. Regulatory Updates
We monitor regulatory developments and update our compliance program accordingly. Material changes affecting users will be communicated through our website or direct notification.
